Ritter Sport's square chocolate fit a pocket and became a trademark no rival could copy

A 1932 idea — a chocolate bar shaped to fit a pocket — became a three-dimensional trademark that withstood a decade of legal attack.

Alfred Ritter GmbH & Co. KG

the move

Company legend dates the square to 1932, when Clara Ritter asked for a chocolate bar that would fit in a jacket pocket without breaking and weigh the same as a normal long bar. The result, 'Ritter's Sport Chocolate', kept the square as its identity; by 1970 the slogan 'Quadratisch, praktisch, gut' (square, practical, good) made the shape the brand.

In 1993 the family company registered the square as a three-dimensional trademark at the German patent and trademark office. When Milka launched a square bar in 2010, Ritter sued; Milka won a first round, but the patent court and finally the Federal Court of Justice (2020) ruled for Ritter, holding that consumers read the square as a sign of origin and quality.

The company itself compares the shape's value to the protected purple of a rival brand: for a comparatively small family firm, the square is the brand.

why it works

  • The square solved a real pocket problem, so the design had a functional story
  • Registering the shape early made it defensible for decades
  • The slogan turned geometry into advertising
  • Winning the court case kept the shape exclusive into the 2020s

what transfers

A functional product feature — the shape — can be turned into legal property, and defending it beats out-marketing: the shape did the advertising for decades.

what came after

Ritter Sport remained a family-owned company and one of Germany's best-known chocolate brands; the 2020 ruling confirmed that no rival may sell a top-brand square bar in Germany, cementing the shape as permanent brand capital.
