背景

The 1984 Bhopal gas disaster and a 1985 chemical leak in West Virginia left Congress facing a problem regulators had never solved: nobody outside a plant's fence line knew what toxic chemicals it stored or released, and there was no fast way to find out. The existing tool, the Clean Air Act's pollutant-by-pollutant rulemaking process, worked but worked on a timescale of years per chemical, with each proposed limit contestable in court by an industry that could out-lawyer the agency indefinitely on the underlying science of what a 'safe' level even was.

Congress didn't have years, and it didn't want to prove, compound by compound, what threshold caused harm before it could act. The Emergency Planning and Community Right-to-Know Act, signed October 17, 1986, sidestepped the fight entirely: instead of telling any facility how much of a chemical it could release, it told every facility above a reporting threshold to calculate and publish exactly how much it did release, by name and address, in a database anyone could search.
